General Terms and Conditions
§ 1 – Provider, Inclusion of GTC
(1) The provider and contractual partner for the goods displayed in our online shop "finecosmetic.de" is Finor GmbH
Kurfürstendamm 194, 10707 Berlin, E-Mail info@finecosmetic.de (hereinafter referred to as "provider" or "we").
(2) These general terms and conditions are part of every contractual agreement between the provider and the respective customer. The customer's conflicting general terms and conditions are hereby rejected.
§ 2 – Product Offering and Contract Conclusion
(1) The provider offers the goods displayed in this online shop for sale. The color representation of the goods on the website may vary slightly depending on the internet browser used and the customer's monitor settings; these deviations are technically never entirely avoidable. Product selection, contract conclusion, and contract processing are carried out in German or English, at the customer's choice.
(2) For the goods displayed in the shop, the provider makes a binding offer to purchase. By submitting the order request via the "buy now" button, the customer accepts the offer to purchase. The provider confirms the conclusion of the contract via email (contract confirmation).
(3) Before accepting the purchase offer, the customer will be shown an overview of the data recorded for their order, including the essential characteristics of the goods. At this point, the customer has the opportunity to check the data for possible input errors and, if necessary, to go back one or more steps in the ordering process to change the data or to cancel the order entirely.
(4) After the conclusion of the contract, the provider sends the customer the content of the concluded contract (contract text) by email. At the same time, the provider stores the contract text in its electronic data processing system. Since the customer does not have access to this, it is up to the customer to keep the email with the contract text for their own benefit.
§ 3 – Prices and Payment
(1) All product prices are total prices plus shipping costs. The fees include the statutory value-added tax.
(2) Information on shipping costs can be found in the respective product description.
(3) The customer can use the following payment methods to pay for their purchase: advance payment by bank transfer, PayPal, Klarna, credit card (via Stripe).
(4) For advance payment orders, a payment period of one week from receipt of the contract confirmation applies. The provider reserves the desired goods for the customer for the duration of the payment period. The provider reserves the right to withdraw from the contract and sell the goods elsewhere if payment is not made in due time.
(5) For deliveries to countries outside the European Union, customs duties and import sales tax may apply, which must be paid by the customer to the customs authority upon receipt of the shipment. These charges are in addition to the purchase price and shipping costs and cannot be influenced by the provider.
§ 4 – Shipping and Delivery Time
(1) Information on delivery times can be found in the respective product description. A specification in days refers to the period from payment by the customer to the delivery of the shipment.
(2) Several goods ordered simultaneously will be delivered in a single shipment; the delivery time of the goods with the longest delivery time applies to the combined shipment. If the customer wishes to receive a specific item with a shorter delivery time earlier, they must order this item separately.
(3) If a delivery fails because the customer has provided an incorrect or incomplete delivery address, a new delivery attempt will only be made if the customer bears the direct costs of the renewed shipment. These costs do not correspond to the shipping costs agreed upon at the conclusion of the contract, which are subsidized. A new shipment will be charged at 4 Euros.
§ 5 – Consumer Right of Withdrawal
(1) A customer who purchases as a consumer has a right of withdrawal according to the statutory conditions. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.
(2) The provider grants a consumer permanently residing outside Germany a consumer's right of withdrawal in accordance with German requirements and legal consequences, even if the consumer's national law does not provide for a right of withdrawal or links the withdrawal to a shorter period or stricter form than under German law.
§ 6 – Warranty (Liability for Defects)
The customer has warranty claims (also called liability for defects) in accordance with the statutory provisions.
§ 7 – Out-of-Court Dispute Resolution
We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board within the meaning of the Consumer Dispute Resolution Act (VSBG).
§ 8 – Final Provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. However, with regard to consumers permanently resident abroad, German law does not apply if the consumer's national law contains provisions from which it is not possible to deviate to the consumer's disadvantage by contract.
(2) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the parties agree that the exclusive place of jurisdiction is the provider's registered office.
(3) Should individual provisions of these general terms and conditions prove to be ineffective or unenforceable, this shall not affect the validity of the remaining provisions.

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us (Finor GmbH
Kurfürstendamm 194 10707 Berlin, E-Mail info@finecosmetic.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax, or email). You can use the attached sample withdrawal form, but this is not mandatory.
You can also declare your withdrawal via our online withdrawal function ("Withdraw from contract") at finecosmetic.de/pages/widerruf. If you use this online function, we will immediately send you a confirmation of receipt on a permanent data carrier (e.g., by email) which reflects the content of your withdrawal declaration as well as the date and time of its receipt.
To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including the delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this repayment.
We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us without undue delay and in any case no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.
